Software License Agreement

Important:
THIS IS A LEGAL AGREEMENT between you (an individual or an entity) and Kingdom Era, LLC ("Kingdom Era"). Please read this License Agreement ("License") carefully before clicking on the "Agree" button. By using this Software or by clicking on the "Agree" button, you agree to be bound by the terms of this License. If you do not agree then click "Disagree" to cancel installation. If you do not agree with the license, then do not use this Software and destroy all copies of this Software, in all its forms (like its disk image), in your possession.

1. General and Copyright. The software, documentation and any other media accompanying this License ("Software") regardless of its form (e.g. on disk, in memory, on USB flash drive, compressed in a disk image, etc) is owned by Kingdom Era (except where noted in the application's credits) and is protected by the copyright laws of the United States and by international treaty provisions. Therefore, you must treat this Software like any other copyrighted materials (e.g. a book or musical recording). This Software is licensed, not sold, to you by Kingdom Era for use only under the terms of this License, and Kingdom Era reserves all rights not expressly granted to you. You own the media on which this Software is recorded but Kingdom Era retains ownership of the Software itself. The rights granted under the terms of this License extends to any software upgrades that replace and/or supplement the original product unless the upgrade contains a separate license.

2. Grant of License. Kingdom Era grants to you the non-exclusive, limited right to install and use the Software on any number of machines as long as all users of those machines agree to the terms of this License.

3. Other restrictions.
(i) You may not modify, adapt, translate, disassemble, decompile or reverse engineer any part of the Software.
(ii) You may not rent, lease, lend or sublicense the Software.
(iii) You may not claim that the Software is yours.
(iv) At all times, you must use the Software in a manner consistent with software licenses granted to you by other companies that have provided software for your computer (e.g. the Mac OS X license agreement between you and Apple, Inc.).
(v) You may distribute copies of the Software only in its original disk image form.

4. Termination. You may terminate this License at any time. Also, if you violate any part of this agreement, your rights granted to you by this License are revoked automatically, without notification or compensation. Upon termination, you must stop using this Software and dispose of the Software and destroy all copies and/or versions in your possession.

5. Disclaimer of Warranties and Limitation of Liability. THIS SOFTWARE IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND. Kingdom Era expressly disclaims all other warranties, expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, satisfactory quality, accuracy, quiet enjoyment and non-infringment of third party rights. YOU EXPRESSLY ACKNOWLEDGE AND AGREE TO ACCEPT THAT USE OF THE SOFTWARE IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK ARISING OUT OF THE USE OR PERFORMANCE OF THE SOFTWARE REMAINS WITH YOU.

IN NO EVENT SHALL KINGDOM ERA OR ANYONE ELSE INVOLVED IN THE CREATION, PRODUCTION, MARKETING, DISTRIBUTION OR DELIVERY OF THE SOFTWARE, BE LIABLE FOR DAMAGES WHATSOEVER; INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION OR ANY OTHER MONETARY LOSS OR COMMERCIAL DAMAGES, ARISING OUT OF, OR RELATED TO, YOUR USE OF THE SOFTWARE OR INABILITY TO USE THE SOFTWARE, EVEN IF YOU AND/OR KINGDOM ERA HAS BEEN NOTIFIED OF THE POSSIBILITY OF SUCH DAMAGES. Some jurisdictions do not allow the limitation of liability for personal injury or of incidental or consequential damages, so this limitation may not apply to you. Any warranties that by law survive the foregoing disclaimers shall terminate ninety (90) days from the date you downloaded or otherwise received the Software. In no event shall Kingdom Era's liability to you exceed the license fee paid, if any.

6. Controlling Law and Governing Language. This License shall be governed by the laws of the State of Colorado. If for any reason a court of competent jurisdiction finds any provision of the License, or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of the parties, and the remainder of this License shall continue in full force and effect.

Any translation of this License is done for local requirements and in the event of a dispute between the English and any non-English versions, the English version of this License shall govern.

7. Notices. Kingdom Era reserves the right to make modifications or improvement to the Software at any time and without notice.
